Name Dropper Terms & Conditions
 

Name Dropper is also referred to as 'the company' in these terms and conditions.

1. It is important that our clients use our services and the Internet in general, responsibly and courteously at all times. Most of our clients do so and seldom need to refer to the Terms of Service.

2. Use of our service/s constitutes acceptance of all terms and conditions herein.

3. These terms and conditions assume a certain level of knowledge in the use of Internet languages, protocols and software. In signing up to our service/s the client agrees that he or she has the necessary knowledge to create and maintain their own web space or that they will engage someone with that knowledge to create and maintain their web space and if they require technical support from Name Dropper such technical support will be chargeable at the company's prevailing rates.

4(a) Customer Service Commitment:
Should you have any questions or concerns with regard to our services, please use the form on the Contact Us page or call 0845 388 2342. We strive to deal with all domain name and hosting questions immediately, but if the issue is complex, within 24 hours. In rare cases, more complex issues may take longer, but we will keep you informed throughout the process.

4(b) Complaints Procedure:
Should you feel dissatisfied with any aspect of our service please send details of your complaint in the first instance using the form on the Contact Us page. We endeavour to respond to complaints within 24 hours and strive to reach a mutually agreeable solution within 72 hours.

4(c) Complaints involving UK domain names:
In the event you remain unhappy with our final response, in cases where your complaint involves .UK domain names, we are happy to direct you to customer services at Nominet, the UK Registry.

5. Domain name registration and renewal.

It is a prerequisite of domain name registration that you read and accept the Terms and Conditions that govern the use of your chosen domain name. Use of Name Dropper's facilities and/or services signifies your acceptance of this prerequisite.

Renewal reminders: We endeavour to send a renewal reminder to all registrants at the following intervals. 3 months, 2 months, 1 month, and 1 week before expiry date. We will also endeavour to give last minute reminders. If you do not respond to our renewal reminders and the domain name expires, it will be suspended by the Registry. The suspension period differs between .UK Domains and .com and other gTLD (global Top Level) domains. See below.

.UK Domains: In the case of .UK Domains, these are suspended 30 days after expiry date. Throughout this period it is still possible to renew your domain name and Name Dropper does not charge any additional fees for 'unsuspending' a .UK Domain name (other than the relevant renewal fee). However, what will happen, is this: any hosting services that are associated with the domain name will stop working. If a suspended domain name is renewed, these services will be resumed fairly soon after renewal (assuming there are no hosting fees outstanding).

Even after suspension of a .UK Domain name there is another period of 60 days before cancellation of the domain name takes place. You may still reinstate your registration up until this time by contacting Name Dropper. For more information on this process see here: nominet/renew

.com and other gTLD Domains: in the case of .com and other gTLD Domains, the process is different. If a gTLD domain expires, it is suspended immediately. There is a grace period of a few days where the domain name can be renewed without penalty - eg: 5 days. However, if the domain name is left in the expired state and you wish to renew it after the grace period, you need to be aware that a redemption fee - which varies - will be added on top of the renewal fee. Depending on the domain name this can vary from £50.00 to £150. These charges are applied by the top level registrar and/or ICANN. We have no control over them. gTLD Domain names that are not renewed are usually cancelled after 30 days.

Our best advice is: to always renew at your earliest opportunity to safeguard your domain names and your associated services. You need to be aware than once a domain name is cancelled (deleted from the registry) it is available for anyone else to register on a first come first served basis.

(i) Refund Policy - Domain Names:
Like all our counterparts in the industry, we operate a no refund and no cancellation policy on domain names. Please double check the domain name you are ordering and make certain it is the one you want. If you make a mistake you will need to resubmit a new application which will be chargeable at our normal price/s.

(ii) Refund Policy - Hosting
We are rarely told a customer is dissatisfied with our services. We are a hands on, customer oriented company who believe in communication and service. However, allowing for exceptional circumstances, if we cannot reasonably put right what you think is wrong, we will discuss appropriate and proportionate refunds at our discretion. This excludes issues outside our control like your own website design, the software used, or scripting; these are not server issues.

(iii) Policy - Domain transfers
Should you wish to transfer a domain name away to another Registrar, our usual fee for this service is £10. This includes gTLD transfers and/or Auth Code requests (eg: .com, .net, .org, .eu etc). In the case of .uk domains, please double check you send us the correct Tag which is always in CAPITAL letters. There is usually no fee if you are transferring in, but in any event, if we have to spend inordinate amounts of time dealing with a transfer on your behalf, we reserve the right to negotiate a fee with you.

5(a) Although we double check domain name registration requests manually before submitting them to the relevant Registry, this is strictly a double-checking service and should not be construed as a guarantee of any kind, nor does it guarantee anything at all in terms of a domain name registration. What we do is what we say we do: we double check the details submitted to us for incorrect entries that may conflict with the rules and regulations governing the use of a specific domain name at any given time.

5(b) Name Dropper reserves the right to decline a domain name registration or renewal request at its discretion. When Name Dropper registers or renews a domain name or hosting account on your behalf, whether through a 3rd party or not, it is understood that it is your responsibility to ensure all registration, renewal, or other required fees have been paid to Name Dropper, and it is your responsibility to ensure renewal of your own domain name. Whilst Name Dropper uses its best endeavours to ensure registration or renewal of domain names, it is understood and accepted, it is ultimately your responsibility, as the registrant, not ours. Use of this website and therefore our services indicates your acceptance of all terms all conditions on it. Please do not use our services if you do not accept these clauses which are standard throughout the industry. Name Dropper reserves the right to withhold services on any domain name or hosting account ordered, until settlement of all debts due or claims under the company's contract with the Registrant or Client are satisfied. This includes refusal of transfer of domain names if such debts or claims are outstanding. Please do not use our services if you do not accept our Terms and Conditions.

6. We reserve the right to refuse an application for a hosting account or to deactivate an existing account should we feel there is probable cause for doing so, such probable cause including spam or unacceptable load on server resources. Name Dropper shall be the sole arbiter of what constitutes probable cause.

7. Affronts to Etiquette
Unacceptable activities include spamming (sending unsolicited advertising to those with which the customer has no existing business relationship, posting off-topic advertising in newsgroups); spoofing (using a return email address which is not the valid reply address of the sender or sending an email message which does not contain enough information to enable the recipient to identify the party who is really sending the message; passive spamming (promoting a web site hosted by Name Dropper by spamming from some other source), trolling (posting controversial messages in newsgroups to generate responses), mailbombing (inundating a user with email without any serious intent to correspond), generating a higher volume of outgoing mail than a normal user (over 10% of available system resources), and subscribing someone else to an electronic mailing list without that person's permission. A message is considered unsolicited if it is posted in violation of a newsgroup charter or sent to a recipient who has not requested the message. Making an email address available to the public does not constitute a request to receive messages. Distribution of mass emailing programs is also prohibited. All recipients on a mailing list must have personally subscribed. Mailing lists may not be used to distribute unsolicited email. Any customer repeatedly "mailbombing" or who attracts such behavior may have their account terminated forthwith. 8. Age
In general, the client must be over 18 years of age to obtain our services. Anyone under this age must make this known to us before attempting to use our facilities. Contact Us here

9. Abuse of the legal rights of others
Examples of unacceptable activities include posting private information about a person without their consent, infringing intellectual property rights, defaming a person or business, and knowingly making available code which will have a deleterious effect on third party computers. Name Dropper supports free speech on the Internet, and will not suspend or cancel a customer's account simply because it disagrees with the views expressed by the customer. Where there are allegations that a customer's on-line activity has violated the legal rights of a third party, Name Dropper will not substitute itself for a court of law in deciding tort claims raised by the third party.

10. Abuse of the law
Name Dropper's services may be used for lawful purposes only. Illegality includes but is not limited to: drug dealing; attempting without authorization to access a computer system; pirating (distributing copyrighted material in violation of copyright law, specifically MP3s, MPEG's, ROMs, and ROM emulators); gambling; schemes to defraud; trafficking in obscene material; sending a message or having content that is obscene, lewd, lascivious, filthy, or indecent with intent to annoy, abuse, threaten, or harass another person; threatening bodily harm or damage to individuals or groups; violating international export restrictions; stalking; or violating other international laws such as the Electronic Communications Privacy Act, the Computer Fraud and Abuse Act, or the Economic Espionage Act. Linking to illegal material is also prohibited. Name Dropper reserves the right to check system files, email, and other data on our servers for illegal content and materials, or for any other reasons deemed necessary.

11. Pornography
Pornography, or links to such material, is not an acceptable use of Name Dropper's servers.

12. Abuse of Name Dropper's Server Resources
Running programs in the background of a Name Dropper server without prior written authorization, or running chat rooms, Internet Relay Chat, IRC bots, and the like are not acceptable uses of Name Dropper's servers. Further, any sustained load of five percent (5%) or more of our system resources is an undue burden on our system and is unacceptable. If your usage ever exceeds five percent (5%) of system resources for a prolonged period of time, your account may be terminated immediately and without prior notice. In addition, accounts using excess amounts of bandwidth will be billed accordingly for additional load upon the system.

13. Fees
All domain name or hosting fees are payable in advance and non-refundable under any circumstances.Vat will be added if applicable.

14. Hacking/Cracking
Name Dropper will report illegal activities to the appropriate regulatory, administrative, and/or governmental authorities.

The following examples of unacceptable behavior are non-exclusive and are provided for guidance purposes only. If you are unsure if your actions will be a violation of our policies please Contact us for clarification.

Server broadcast messages or any message sent on an intrusive basis to any directly or indirectly attached network, attempts to circumvent any user authentication or security of host, network, or account. Accessing data not intended for user. Probing the security of any network. Spawning dozens of processes. Port scans, ping floods, packet spoofing, forging router information, Denial of Service attacks, sniffers, flooding, spoofing, ping bombing, smurfs, winnuke, land, teardrop. Promulgation of viruses. IRC bots such as eggdrop or BitchX. Any activity, whether or not the intrusion results in the corruption or loss of data, will be investigated and appropriate action taken. The presence of any of these programs, whether or not run, may result in action against the user including suspension or termination.

15. Client Responsibilities
The client is responsible for all activity originating from their account unless proven to be the victim of outside hacking or address forgery. The client is responsible for securing their username and password. Use of Name Dropper's services requires a certain level of knowledge in the use of Internet languages, protocols, and software. (See also
Clause 3 above) This level of knowledge varies depending on the anticipated use and desired content of the web space by the client. The following examples are offered: Web Publishing: requires knowledge of HTML, properly locating and linking documents, FTPing Web contents, Graphics, text, sound, image mapping, etc. FrontPage web publishing: knowledge of the FrontPage tools as well as Telnet and FTP understanding and capability. CGI-Scripts: requires a knowledge of the UNIX environment, TAR & GUNZIP commands, Perl, CShell scripts, permissions, etc. Mail: a use of mail clients to receive and send mail, etc. The client agrees that he or she has the necessary knowledge to create and maintain their web space or that they will engage someone with that knowledge to create and maintain their web space. The Client agrees that it is not the responsibility of Name Dropper to provide this knowledge or support outside matters specific to Name Dropper's servers and that any technical support or assistance above and beyond these matters will be chargeable at the company's prevailing rates.

16. Backups
It is the client's responsibility to maintain local copies of their web content. If loss of data occurs due to an error, the company will use its best endeavours to recover the data but no guarantees are made of any kind, either expressed or implied, as to the integrity of any backups made. Backups are made for server restoration purposes only. It is the account holder's responsibility to ensure backups of their web site and all other data transferred by themselves.

17. IP Addresses
Name Dropper maintains control of all or any IP addresses assigned to the client and reserves in its sole discretion the right to change or remove such IP numbers and addresses.

18. Limitation of Liability
We cannot guarantee that our service will never be faulty but we will endeavour to correct faults as soon as we reasonably can. We will also endeavour to make the Service available 24 hours a day 7 days a week but from time to time faults may occur which affect this level of availability. Name Dropper shall not be responsible for any claimed damages, including incidental or consequential damages, which may arise from Name Dropper's servers going off-line or being unavailable for any reason whatsoever. Furthermore, the company shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Name Dropper's servers.

19. Name Dropper reserves the right to terminate an account if any activity on that account threatens or jeopardises the company's servers and/or other account holders or if the company is in dispute with the client and such dispute cannot be resolved amicably. In any event, Name Dropper shall be the sole arbiter of what is and is not a violation of the acceptable use policies herein. Name Dropper reserves the right to delete all content and files upon termination and reserves the right to withhold any pre-paid funds for any site removed for violations of these policies. Name Dropper reserves the right to refuse, cancel, or suspend one or all of its services to any individual or company at our sole discretion.

20. Name Dropper may change or update these Terms and conditions from time to time to accommodate changes in the market or Internet protocols. If you wish to keep updated with any such changes please revisit this page at regular intervals. Non-enforcement of any part of these Terms of Service does not constitute consent. In any event, Name Dropper will be the sole arbiter in any dispute and by signing up to the company's services the client is deemed to have accepted this proviso.
